1. If this is true and he is convicted in court, they should lock him up and throw away the key.
2. What happened to due process with everybody else's comments on here? Should we just eliminate the criminal justice system and lock everybody up for being accused of doing anything wrong? I think they should pass a law that prohibits media from publishing stories like this until someone is convicted or exonerated.
As alarsen has pointed out, due process and beyond a reasonable doubt doesn’t really apply here.

It is also entirely in the public interest to report on this and name the defendant even if he is found not guilty. Convicting someone of sexual assault is really difficult. And while it’s possible that the defendant would be exonerated if this goes to trial, it’s not likely. It would basically require the victim to admit to making it all up. Instead, if the jury finds him not guilty it probably means they think he did it but there’s a reasonable doubt he didn’t do it. In that case, people need to know that he was the accused so that they can try to avoid being his next victim.

He was charged with Sexual Abuse-3rd Degree (Class C Felony) and Domestic Abuse Assault-Injury or Mental Illness-1ST OFF (Serious Misdemeanor)
 
Since the domestic violence has been admitted to, shouldn't he have been dismissed from the team and University in January?
Criminal Complaint was issued on 5/2/2023. It allegedly happened on 12/3/2022. Search warrant was conducted today.

They did. Third degree sexual assault (Class C felony) and domestic abuse assault causing injury ( serious misdemeanor).

I am not sure why they didn’t charge him with first or second degree sexual assault unless they don’t think her stress fracture rises to the definition of serious injury. I suppose maybe they haven’t gotten medical records and could bump it up.
 
I find it interesting that the excruciating detail is presented here but if you read the new Jackson Mahomes story zero detail is given

I agree with most of this. You lost me at your last sentence.

As important as due process is, so is freedom of the press.

I wonder what physical evidence they have beyond the testimony of the victim.

I would imagine they have the medical records for the treatment of the back injury. Maybe that also includes documentation of trauma to... let's just say "intimate" areas... and/or a sexual assault kit.

Even those things can be disputed, though. As @alarson pointed out, these are notoriously difficult cases --

Evidence: "She sustained a significant spinal injury because you pushed her."
Defense: "She fell, which is a terrible tragedy, but on her own. You can't prove I pushed her."

Evidence: "There's physical evidence of a sexual assault."
Defense: "We had consensual if rough sex the night before the incident. We'd been dating for years."

So much can still come down to he said she said. And so many victims aren't willing to testify in open court and/or change their mind at the last minute. I have nothing but sympathy for them and hope our society would not shame or blame the victims, but these are the difficult realities they don't show on SVU.

I do agree the DA must really feel s/he has the goods before the charges came down.

Likely medical records for the back injury and sexual assault kit. What other physical evidence would they need? What other physical evidence might there even be?

Per the article, "Ralph admitted to police he shoved the victim and his actions caused her injuries." Sure, he could change his story in court. But the police will testify that he admitted, and he will be asked to explain why he admitted to it if he's now saying he didn't do it. That would be difficult to explain to a jury I would guess.

I suspect if it took this long to charge him, the prosecution has been gathering evidence and wouldn't have now filed charges if they weren't sure they had enough to convict.
 
So the defendant looks like a criminal justice major?

Given he would not help her get medical attention and raped her multiple times, kind of wonder if kidnapping should be charged? Of course I always wondered why it wasn’t charged in Pierre Pierce known rape victim number two case.
 
He admitted in the police report that he shoved her and caused her injury. Pretty easy "code of conduct" dismissal from the team and university based on that alone.
That is my thoughts as well. Didn't he brake Student Code Of Conduct?
 
I think Story County has a pretty good history of prosecuting cases like this. Johnson County on the other hand, not so much. If this happens in Iowa City the kid walks or worst case gets 30 days in jail after being allowed to torment the victim for several months.
