There might be a simple reason why there is not a straight forward answer to this situation - and might very well not be until August enrollment.
I'm not going to take the time to dig into the current regulations, but I know that at least in the past there was a big advantage to a prospective student athlete (PSA) to be classified as non-recruited if they plan to walk on to an athletic team. If a staff recruits someone to walk on based on their athletic ability, they are almost always prohibited from accepting institutional financial aid to help with their expenses if they see game time.
It doesn't take much to be considered recruited - scouting a game, video tape review, phone calls, even a letter of interest. If someone simply shows up with no prior recruiting contact, they would have more options in terms of receiving financial aid without being counted against the limit for the team's scholarship numbers.
The drawback for the PSA is that they might not be given the opportunity to join the team if they were not invited in advance. This would probably not be an issue with Payton given his background and pedigree.
There could be some implied trust on the part of both sides through unofficial 3rd or 4th hand contacts that doesn't qualify as someone being recruited. It's a unique situation, but one that could lead to Payton joining the team next fall without restrictions on being eligible for financial aid or on being labeled a counter.

Given that no one has confirmed or denied this (as mentioned earlier), I do wonder if there is some situation like this where no one can really comment.

I really hope it is true, it would be cool to have Gary Payton in the stands and from his highlight video he looked like he would be a pretty good walk on.
His source is Chris Williams and Cyclonefanatic so it doen't mean much more than what you've read here. I don't believe anything until I here it from Marty's dentist.
