IF all he was doing was sitting in a car, then this is seriously ****ed up. I've actually known people this has happened to (one guy was just trying to warm up in his car during the winter), and it really pisses me off cops are allowed to issue an OWI in this situation.

I went over there just after seeing your comment and a lot of their comments are like this....."If you look at their roster it looks like a bunch of hype to me. They have a couple of good players, but most teams have a couple of good players. They don't look to have much depth if you look at their roster".....like i said....a bunch of stupid.
Keys in the ignition is the deal though....means there is an intent to drive which i can understand. Ive had it happen to me where i was stopped after my car broke down and had a few but i had the keys outside the vehicle on the ground and theres nothing they can do and i probably would have been over the limit. Sure enough state trooper pulls up and says well take your keys back and get home safe after the taxi gets there. I let him leave and through them out again cause sure enough he radio notified another one that stopped by.....and keys were sitting out so they were setting me up.

He should have been sitting on the passenger side smoking the weed.Sucks, though on the bright side at least he wasn't driving at the time. My brother got a DUI for the same reason years ago - he was at a party and decided he wanted to get away from everyone for 15 minutes. It was cold out so he sat in his car instead of hanging outside. He had the car on for the heat. Cop saw him and nabbed him even though he wasn't driving. Since he was in the driver's seat and the car was on, it's still a crime. It looks like an intent to drive even if you say you weren't going to drive.

Because his car magically got there on its own? Pretty clear how the car got there, and he was intoxicated.
Shouldn't be any problem here, outside of Hogue's judgment.
Yeah I don't necessarily think that you should just get off free but I think it needs to be a different charge.That's why I prefaced it with IF. If he was driving, then he deserved to get caught. I don't really know much of the details of where it was at and if he was alone or not. I've just heard many stories of people just sitting in the car and getting busted for this, and that's not right in my opinion.
