No, but an effective prosecutor could sway a jury that there's no reasonable doubt he was sober. Depending on that information.

In Wisconsin there’s basically two owi charges: that you were over the limit or that you were too intoxicated to drive regardless of whether you were above or below the limit. Is Iowa the same way?

Circumstantial evidence isn't very strong. A skilled DUI lawyer will destroy most of that. DUI cases can be hard to prove without a breath or blood sample taken that shows they were over the limit.

Hope the other guy sues the hell out of him and wins. I don't think much of people who injure others and run away.

This is likely whats going to happen even if they DUI gets dismissed.

Wow. So any police officer can pull you over and if they "determine" you are impaired you get a DUI. I'm sure that power hasn't been abused before.

Doesn't sound like Iowa has a similar law though...

Then again, Iowa will give you a DUI if you have ANY trace of weed in your system. Regardless of when you last used it.

Iowa code says the same thing, operating while under the influence OR while having a BAC over .08

1. A person commits the offense of operating while intoxicated if the person operates a motor vehicle in this state in any of the following conditions:
a. While under the influence of an alcoholic beverage or other drug or a combination of such substances.
b. While having an alcohol concentration of .08 or more.
c. While any amount of a controlled substance is present in the person, as measured in
the person’s blood or urine.

It’s the same charge, but yes. It’s just really hard to prove intoxication without some obvious video evidence when there’s no BAC.

Go read the case of the Ames principal who got out of his OWI. This seems less likely to stick than that one.
