Anyone else have bad experience with these guys? My daughter moved out of one of their apartmeents over 3 years ago. We recieve a letter last week claiming we owed them money. (Have not heard from them in 3+ years). We had major issues trying to get AC fixed and when we left my wife was very clear with complex manager that we were square. Now they claim we turned in keys 2 days late (want full month rent) and there was damage to apartment (bogus). Scam if I ever saw one. Anyone else experience this?

If you have a lawyer in the family have them draft a letter that bascially says **** you. :biglaugh:

I am going to agree with the person who says I've never heard of a good experience with that group. I haven't either. A few years ago my bro-in-law lived in one of their units. Came home from work one day to find his toilet cracked and apartment flooded. Manager accused him of "attacking" the base of his own toilet with a sledgehammer. Nevermind he wasn't home when it happened, didn't have any roommates and didn't own a sledgehammer. And also he's not a complete loser who would do such a thing for his own amusement. They did eventually admit it wasn't his fault and put him into another unit. But again, I've never heard of someone having a positive experience with them and believe they are truly criminal.

Sounds like what Cochran pulled on me, then I threatened them with small claims court and they gave me my full deposit back (which was my plan because it was cheaper for them to refund my deposit than it would have been to have their attorney even look at my claim).
 
I'm almost positive they only have 30 days to do anything about it after the contract expires. They have to provide you with an invoice stating what your being held for, and then if nothing is given out, you're in the clear.

I believe this is correct. It could be longer then 30 days but if it is, it isn't much longer then that. I agree with the poster that says have a lawyer in the family draft a letter stating **** YOU!!!!! Then have them served. :yes:

Yes, this is correct. They have to provide an itemized listing of repairs done within 30 days of lease end. Failure to do that results in you getting your entire deposit back. Actually took a landlord to small-claims over this, he had his lawyer send us a bill after we filed which included a made-up invoice from a carpet cleaning guy that the landlord created on his own computer (idential font size, type, to his other charges etc. plus I went to visit the carpet cleaning guy who said he was on dialisys and hadn't been physically able to clean carpets in years).

Probably would have won the case just based on the time-frame of over 30 days, but it was nice to give the judge all the other crap in front of his attorney.
 
Technically, they can treat you as a holdover tenant for a like period of time (a month in this case) if you stay late. I think they would first run into a statute of limitations problems having not brought the claim in 3 years, and also if you made a payment and made it explicit that it was in consideration for all debts and they accepted, you will be fine.
 
Yea, I lived in one of there places about 2 to 3 years ago. I get a letter from them every six months to a year. Saying that I still owe for repairs, painting, cleaning, etc. Something around $600. Which is absoultley bogus. We even had an inspection when we moved out and they said that everything looked good. Ive writting them a letter saying that I will not pay for anything until they send me copies of the bills of the companies that did the repairs and what the repairs were on. Havent heard from them for awhile. Guess Im prolly due. Plus I still gets bills from Mediacom that I had there also. Glad I moved to Des Moines

the guy that owns that and Robert Miell were best buds and if you know anything about Miell you know hes scum and the Kelley guy isnt much better I hear.....I think hes a convicted felon actually

I suspected they were just fishing. The letter threatens a collection agency. Which I'm sure some people will pay when they read that even if it is bogus.

Miell is currently in jail or if he's not he's out on appeal and Kelley has also done time. It sounds like he's out now and trying to make up for lost time.
