Do I have a case?

Here's the story:

I'm 18 so obviously underage and last Saturday night I was at my friends house who was having a party. At around 11 one of my friends left to drive his car home and crashed. He was drinking. Me and my buddy happened to be standing in the driveway of the house we were at when he crashed and ran over to see if he was alright. We also had been drinking. The neighbors came out and called the cops and so me and my buddy stayed around because we assumed the police would want us to write witness reports. Instead the cop arrested me and my buddy for public intoxicaion. He never gave a chance for me and my buddy to explain that we were only waiting there because our friend was bleeding from his head. We both got taken to jail for the night.:shocked:

Does anyone know if I should plead not guilty and tell the judge what happened and possibly get it taken off or should I just accept the public intox?

note: I also got an MIP in May I don't know if that affects the judges thinking.

You should probably avoid drinking, but no I don't think you have a "case". You were in public drunk so therefore you got a drunk in public. It's not a big deal, I have one myself... I would get a public defender and ask him what you should do, because this is a forum and not a legal advice place.
 
You were drunk and in public. Why do you think you shouldn't have been arrested for a crime you admit you were guilty of? Tell your friends not to be stupid and drive after they have been drinking.

Stay out of trouble and you can get it taken off of your record in 2 years.

1) Were you in public?
2) Were you intoxicated?

The prosecution rests.
 
You are probably screwed with the ticket, but the cop is definitely an ******* if you were just going to make sure your friend was ok.
 
Was this in Ames?

I'm thinking if you were cooperating with an investigation, despite your drinking that

A) There is something else that happened you aren't telling
B) You met a total **** for a cop

The cops in Ames are pretty good about public intox. Seem to let you go as long as your not causing trouble or making a scene.

did you do a field test? Did you admit to drinking? If you are on probation for the MIP it could be affected. Call a lawyer, even a PD if necessary.
 
No. Go buy a 24 pack. Then you will have a case.

If you intend to fight it, I would have an answer ready for the judge's toughest question...

"If you were so concerned about your friend, why did you let him get behind the wheel of a car when he couldn't even make it down the street without crashing?"
 
If your old enough to serve in the military. Your old enough to drink. That's why the voting age is 18.

If you join the military you can drink legally on base (beer and wine coolers) when you are 18. Since Baller didn't join the military and wasn't on base he is screwed.

If you're a student, call student legal services at the Memorial Union for some legal advice. You may have a defense of necessity as you were trying to perhaps save the life of your friend.
