Always file with the other party's insurance. You won't get surcharged for a not at fault but you're going to lose claims free discounts for sure and, depending on your carrier, you could lose a safe driving discount.

You can definitely involve your agent but the claim needs to go through the other party.

Thank you for saying much better what I said earlier. Claims history anymore is part of you insurance score which get applied to future pricing. All Claims filed with you company can and will have an effect on future rates.

So I was in a car accident today. Luckily I'm fine (so far) but it required an ER visit and an ambulance ride. My car is toast. The driver who I believe was at fault was a semi driver who didn't see me in his blind spot before trying to merge and hit me sending me across 3 lanes of traffic into a cement barrier where another lucky car rear-ended me.

I've only been in a minor fender bender and hit a deer, so I've never had to deal too much with someone else's insurance. Is there anything I should be make sure to do?

I've started a claim with my insurance, but I want to make sure I'm doing everything I should. The first person I talked to at State Farm today, didn't seem especially competent (when I said that the semi that hit me was a Freightliner, she asked if that was a Buick). Hopefully I'll get a new person tomorrow. But should I have both insurance companies give me a price for the car replacement? Should I listen to my State Farm person and just go through them and let them deal with the other insurance company (her reason being that the other person might not have good insurance)? How much should I directly deal with the other insurance company? Anything else I should be aware of?

On another note, just how hard is it going to be to buy a new car right now? I hate car buying in the best of circumstances, but I'd like to find something that I like.

If you were slowed down on 235 this morning right around 7:00, you have me to thank (or more accurately the semi driver who did not see me). But at least you weren't the poor guy with a brand new car who rear ended me after I spun around. ;)
Yikes! Glad you’re ok. I was about to head downtown when I heard 3 lanes were closed and there was a 2 hour backup on 235. Opted to work from home…and was wondering about those involved (if they were OK). Again, glad to know the answer is yes. I would get checked out by a chiropractor though. You’re likely going to feel the aches tomorrow…and the other driver’s insurance should cover all those charges.

If at any point you don’t think you are being treated fairly by insurance, there are no shortage of lawyers who will welcome a free consultation with a potential client who was hit by a commercial trucker and went to the ER. In fact I would encourage you to consider speaking with one now because (1) any reputable one will consult with you for free and (2) they may have good ideas about evidence preservation, such as medical examinations you should have done now, that you may not have thought about.
 
I've heard of people doing it both ways. I was recently involved in an accident with the other person at fault. Actually on the way to the KU-ISU FB game, sorry for everybody who got slowed down on K-10. I assume you have the police report, but that's the most important thing to have and then it should be relatively straightforward with insurance compared to trying to sort through a fender bender.

I decided to start first with the other at fault's insurance (partially since our insurance was out of state) and everything has gone very smoothly. Got a loaner rental car and all the repairs approved quite easily. Remember, the other insurance has an incentive to possibly win you over as a future client. But I also wouldn't hesitate to go through your own insurance if you have any concerns whatsoever.

The repairs on ours haven't been completed yet as it's been a nightmare finding body shops without more than a month wait.

Also, I've had a car on order since April, that finally got built last week. So yeah, finding cars is tough. Although if there's any silverlining, I don't think there's as much needing to haggle or search for the best deal. If you order, you'll get it for MSRP. If not, everything we looked at was being priced above MSRP but it seemed like the pricing was kind of take it or leave it. Love to hear about other experiences though.
