In my over 20 years of experience as a prosecutor and criminal defense attorney, I've come across many similar cases involving false accusations. (And, many where the accusations were true.) The person making a false claim of sexual assault is never prosecuted. If they were prosecuted, it could deter other victims who actually were assaulted from filing a complaint.
That needs to end. At the very least the accused's name should be protected as much as the accuser's.
 
I cannot wait until in never have to hear about bubu ever again, and I'm extremely happy he didn't play last year because Monte got gobs of experience he may not have if bubu was playing.
When did you have to hear about Bubu? You had to open this thread?

I've said all along that JP and Leath handled this whole thing horribly.

It kinda disturbs me to hear JP say that he felt Bubu acted "immorally". Ok, that's fine, but that is your opinion and your judgement. That is not enough to kick kids off of teams IMO. And it appears, thus far, the courts agree.

I really think JP and Leath figured they could throw their weight around and Bubu would go away with his tail between his legs. But Bubu fought back, and rightly so, to protect his name. It backfired on JP and Leath.

One observation. The "immoral" comment was not a public statement that can be verified. We have only the word of an anonymous poster for that comment, and his depiction of the email struck me as a "cool story, brah" situation.

The public statement made by JP was very stilted, abrupt, and was not at all like his usual public statements. I have wondered if it was scripted for him. As AD, it is part of his duties to be a liaison with the press and the public, so if anyone made the statement regarding the judge's ruling, it would be him. President Leath, on the other hand, spoke entirely off the cuff with the press.

I get the reasoning behind this but in my opinion it allows for people to spew false accusations without fear of repercussions. I don't want to scare people away from coming forward but we also need to protect people from being falsely acused.

JP's public comment of "honor before victory" when it came to not wanting BuBu on the team certainly insinuated immorality if not more. Like somebody else posted, JP and Leath would have been far smarter to just say "no comment", like Fred and BuBu. If I remember right, Leath even went so far as to send a letter to the Ames Daily to try to justify his position. What was confusing is he said he basically agreed with the finding of the ALJ, just not the way he applied the ruling. That made no sense.

Exactly. Lives have been ruined by false accusations, and it can also make it harder to believe truthful accusers if everybody knows there are no repercussions for lying to the authorities.

“If you don't value honor before victory don’t play (at ISU). But I’d also tell them of the last six student-athlete misconduct cases come before us, every single one of them was ruled for the student-athlete except this one. And that should tell them something.”

I totally agree that false accusers should also be prosecuted. I was just stating the public policy reasons behind why they are not prosecuted.

Something fishy was going on with this whole Bubu thing. JP and Leath were not being consistent with how they handled other athletes getting into trouble. They were getting pressure from some one, or some group. Had to be IMO.

You could be right about that, I just don't understand how they justify the public statements against Bubu, especially with the case in the courts. That gave them a perfect excuse to say "no comment".

Please provide a link where JP said it, because I honestly don't recall him saying anything other that the brief statement after the appeals court judge issued the temporary stay last winter that allowed Bubu back on the team.

I googled Pollard+Palo. Every link was to the same statement. This is an example from 13 WHO.tv:

Pollard’s only statement came in terse, written form:

“We are disappointed to learn of the district court judge`s decision to reinstate Bubu Palo to our basketball team. We believe the university should have the sole right and responsibility to determine any student`s participation in extracurricular activities at Iowa State.”
 
I have said all along that as the head of the Athletic Department, Pollard was being forced to toe the company line (so to speak). If you can show me anyplace where he has commented negatively about Bubu using anything but the quote in my previous post, I will back down from that.

Otherwise, please consider the possibility that JP is not as complicit in this mess as you believe him to be.

There may have been an tweet from JP, rather than a formal comment to a reporter.
 
Then someone who follows him should post it. People keep saying JP badmouthed Bubu, but other than that one statement and a description of comments in an email from Pollard to another poster, I have not seen anything to that effect. I'm willing to say I'm wrong, but no one has produced anything substantive yet. Can you?
 
Like I've said before, HER (the "victim") had a lawyer/someone on her side with the law that is also a part of the Iowa State Student Safety Affairs or some "student safety" thing like that.

The rumor that I heard was she threatened to have her board (student safety board) sue/go the court with Leath if he didn't stop Bubu.

First part I'm 90% sure on, just can't remember the exact name of the board she is on. The second part I'm not very sure on. I know her role within the university had pretty much put Leath in a corner
 
Leath completely ****ed everything up, and Pollard's public statements are to keep his job.

If you're a teacher, you don't badmouth the administration to the students. Say what the administration wants with a smile.

If you're a receptionist, you don't badmouth the CEO to the clients. Say what the CEO wants with a smile.

If you're an AD, you don't bad mouth the president to the public. Say what the president wants with a smile.
