I agree. And I think Schefter probably knew it when he tweeted it, too. He and his bosses must have just decided that whatever the eventual settlement would be was worth it to be first to report.

That's kind of where I fall as well. ESPN knew that the medical chart itself had to be obtained illegally, before it was published. I'm not sure if publishing it is technically illegal, but it certainly was in poor, poor taste. I suspect they'll settle.
