Yes it does. There is no legal definition of "public" as previously stated. If I sent a pic of my junk to a GF I would consider that Private between me and her. If she showed it to a friend I would still consider it private between the three of us. If she sent it to her friend and her friend... -

I disagree. You lose control of it once you hit send, but it's not public until someone makes it public. -

This is what bothers me. It wasn't a public matter. It wasn't spread around to the public. It was between two people. Public=Fired Private=Who knows. I do want to respect the employers ability to fire someone for this. But it was a private matter until the Mom got involved. -

That wouldn't have been offsides in soccer either. You can breakaway in soccer, but you must not break until a ball is sent. And halfline is the determining factor of where you must stay behind the defense. But once a ball is sent it's a free for all.- CTAClone

You go away for that 5 minutes you may miss three shots and a goal. So you can't leave. Think of offsides as not allowing a receiver to start running as soon as he wants.
