Property Access for Tree Removal

You can’t compel them to. I think that if the tree is dead or dying, you have to give the owner of the tree a letter stating that the kind of tree and the issue with it. That way the owner is held liable.

I think the “act of god” only holds true on a live healthy tree. Why should you be responsible for your neighbor’s dead tree that falls and damages your property?

Not an insurance guy so just my opinion.
The letter may help with subrogation but they don't really hold up.

It sucks. I don't think you can find anybody associated with insurance that doesn't absolutely loathe trees.
 
OK then. I'm just beginning to read p. 2 of thread and see the tree fellers are already there. I'll keep reading but the whole thing is likely over by now? Good luck anyway.

The party is in full swing now. Tree fellers just added another body as a guy with woodchipper showed up. No visual signs of blood splatters on it. Eccentric neighbor is helping them rake branches. Overheard Jason tell one of the guys that eccentric neighbor wants to keep everything over 3" in diameter. :oops: Have no idea why as they don't have a firepit or fireplace. $1700 to take tree out, remove branches, and grind stump from what neighbor told me. Good deal on the neighbor's end. 5 hours in and main section of tree is still standing. I feel for anyone doing this kinda work when it's this warm out. Reminds me of stacking hay bales in the barn during my summers back in the day.

Many services charge a ton to haul away. He probably balked at the additional cost.

We have a neighbor in the 40s that does that the instant someone (other than the neighbor) is working in a neighbor's yard. Turns beet red, repeats it multiple times and varies between "don't step on my property" to "don't come near my property" and the cops will be called if anyone does. Also has property cameras recording everything, plus will be outside with the iPhone recording.
Okay I was joking. I actually live on a 160 acre farm. But when I was delivering mail, I ran into a ton of these people.
 
I believe when there is an "act of god", there is no liability if a tree on your property does damage to a neighboring property.

However, if it is known and documented that the tree is dead, and it causes damage, you are probably liable.
Yeah, I think it is something like: If you (or an arborist) are cutting down a dead tree on your property, and it falls on your neighbors house, you are responsible. If on the other hand, you leave the dead tree alone, and it later falls on its own, damaging the neighbors house, you are not responsible. The neighbor (or his insurance) has to cover it.

I'm not totally sure on this, but might be close.
 
In case anyone doesn't know this, if part of your neighbor's tree is hanging over your property, you have the right to have everything on your side cut down and vice versa. And as others have said, if your tree falls on your neighbor's property, everything on their side now becomes their problem.

Facts. I have a neighbor with a black walnut that grew out over my driveway and roof of my house. I got tired of the debris filling my gutters and not being able to park my car in that area of the driveway for fear of walnuts denting it.

I let them know I was going to have it trimmed back and luckily they knew this stuff already and were perfectly fine with it. That tree is only about 2 feet from the property line so I petty much had them trim it back to the trunk on my side, since I know it's gonna re-grow and need done again.

I'm lucky to have pretty good neighbors in my neighborhood -- everyone is pretty friendly, but also mostly keep to themselves. A perfect combo IMO XD
 
My dad was a laborer for the DM schools. He also had tree business at night and on weekends. I used to pull brush and do grunt work on the ground for him. I used to talk smack to him that I was doing all the work. When I turned 18 he finally told me to put the spikes on because he was done listening to me. After about an hour and a half later and me huffing and puffing. He said, “get out of the tree boy we aren’t making any money with you up there.”

When I bought my first house I needed a tree shaped up next to the house. I asked how much and he said $400. I then asked how much if I helped. He said $800 I’ve seen you work. God I miss him.
