I got selected for Jury Duty when Im supposed to be out of state on vacation. What can I do to get out of this ? I really dont want to miss this vacation as Ive been planning on it for years.

Thanks

You can write back with your list of reasons for being unavailable. I am in construction, and they called me at the very busiest time possible, and I requested to be deferred to the winter, and they granted it. I imagine they'll give consideration to you if you list out all the expenses and inconveniences that you would incur (in a nice way).

I have the same thing happen earlier this summer. I had plane tickets bought, etc. There is usually an option for potential jurors to give a reason why they can't attend. I just went online and said that i couldn't attend because of plans to travel out of state, tickets purchased, etc. Within a couple days i received a response that i was dismissed.

Just request a new date. Should be able to do that. Tell them why you need a new date

Make a request in writing when you return the questionaire about why the time doesn't work for you and you will hopefully hear back soon that you are excused.

I was summoned for jury duty two weeks ago. I overheard two people discussing this scenario. Call the Clerk of Courts and talk to them about what you need to do. You may be able to get it deferred if they think your reasons are legit.

They are usually just happy you followed and gave a reason for not being there instead of just ignoring it and creating stuff for them to do as a result of you not showing up. You might get yourself dismissed and then be scott free for the next few years or they might just push you back to a later point.

Fun side story, my wife showed up for her summons and actually expressed interest in being there. She was then dismissed, I guess interest in being on a jury panel is a disqualifier and they'd rather have people who don't want to be there but are forced to. Yay legal system.

Depending on your profession, that may get you out of it as well. I have heard of several instances for people that are engineers get out of jury duty just for that alone.

yep. And they can probably show that just by showing that it didn't get returned to sender

I have occasionally gotten someone else's mail put in my box (addresses are similar). Without the state having the proof of delivery, they can't actually prove the postal worker placed that letter in your mailbox.

I digress, you should absolutely do your civic duty and just let them know you can't do it now but will do it later.

Yep it doesn't matter. I have a job where we continually notify people of violations, send out court summons, etc. The biggest excuse we receive is "I never got it in the mail". Judges couldn't care less. All we have to do is show which address we sent it to, and thats the address the person still resides at.

Just say you want to be on it because you enjoy seeing guilty people come to justice. Or that you banged one of the people or their spouses.

I'm not saying this isn't the current case it very well may be but if it is it needs to change. If you want to prove someone receives something you need to send it certified mail. If not there are to many variables where it doesn't actually get to the person. Now I'm sure most people that would say they didn't receive it are full of **** but in our society we need proof you committed a crime which is what ignoring something like this is.

Either way you should respond to a summons as it is the right thing to do.

The problem is that more than half the people that get certified mail either refuse to sign or just ignore the notice to come get it at the post office, and it just gets kicked back. Also, each piece of certified mail cost us about $6, which kills the budget line item extremely fast.

That's not the problem of the legal system. There are other ways too. Just sending it to the correct address shouldn't be proof someone received it. People should sign for stuff like that or go pick it up but we need proof not just probability they received it.
